Preamble & Operator Identification

These Terms & Conditions of Sale ("Terms") govern every purchase made on orthoscare.com (the "Site"), operated by Minatura Health and Beauty, Lda., registered at Rua Centro de Artes, 8 – Loja H, 6200-505 Covilhã, Portugal, VAT/NIF PT 513418261. By placing an order, you accept these Terms in full.

1. Eligibility

You must be at least 18 years old, or the age of majority in your country of residence, and have the legal capacity to enter into a binding contract to place an order.

2. Products & Pricing

• Product descriptions, images, and specifications are provided in good faith; minor variations may occur.

• Prices are shown in the currency selected for your region and, where legally required (EU, UK, Australia), are inclusive of applicable VAT/GST.

• Prices exclude import duties and taxes charged at destination for orders shipped outside the seller's customs union, unless the checkout explicitly states "duties included".

• We reserve the right to correct pricing or listing errors before an order is confirmed, and to cancel an order affected by an error, with a full refund.

3. Order Acceptance

Your order is an offer to buy. A contract is formed only when we send an order confirmation email; we may refuse or cancel an order due to stock unavailability, suspected fraud, or a pricing error.

4. Payment

Payment is processed securely at checkout via the payment methods displayed (card, PayPal, Apple Pay, Google Pay). Full payment is collected at the time of order unless a "buy now, pay later" method is used, in which case that provider's own terms apply.

5. Delivery

Delivery timeframes are estimates; see the Shipping & Delivery Policy for full detail by region, and title/risk in the goods passes to you upon delivery to the address provided.

6. Right of Withdrawal & Returns

EU and UK consumers have a 14-day statutory right of withdrawal; customers in other regions may use our extended 30-day return window. See the Statutory Withdrawal Form and Refund & Returns Policy for the full process.

7. Legal Guarantee of Conformity

All products include the minimum 2-year legal guarantee of conformity required under EU law. See the 2-Year Conformity Warranty page.

8. Limitation of Liability

To the extent permitted by law, our liability for indirect or consequential losses is excluded. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law, including liability for death, personal injury, or fraud.

9. Force Majeure

Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including customs delays, carrier disruption, or natural disaster.

10. Governing Law, Jurisdiction & Complaints

• These Terms are governed by Portuguese law, without prejudice to any mandatory consumer-protection rules of your country of residence.

• Consumers may also bring proceedings in the courts of their own EU member state of residence.

• EU/EEA consumers may use the European Commission's Online Dispute Resolution (ODR) platform, and Portuguese consumers may use the Livro de Reclamações Online, both linked in the footer.
